Session 2: Who’s Watching the Crypto Bank and What About the Crypto Derivatives?

The rise of crypto has spawned services and products from crypto banks to crypto options, creating a range of financial opportunities and risks, and related illegal acts, analogous to those for sovereign currencies. The nature of crypto, backed by no country and nascent regulation, adds another layer of potential illegal opportunities. In this session we discuss the range of crypto products . . . from Spot Bitcoin and Ethereum, to Bitcoin Futures, Cryptocurrency ETFs, Swaps, Crypto Options (physically-settled and cash-settled), Crypto Tokens and Stable Coins. The regulation of these products is very much in flux – recently passed landmark legislation includes the GENIUS Act, which focuses on regulating payment stable coins, outlines backing requirements and includes new consumer protection measures, and the CLARITY Act, which aims to clarify the regulatory framework for digital assets overall. This rapidly evolving regulation will ultimately determine who oversees, establishes rules and practices, and raises legal challenges to the use and abuse of crypto and crypto products. About the Presenters:

Dr. Timothy Weithers has worked for over 30 years in the financial industry, mainly at trading firms and investment banks; he was a Managing Director at UBS and has a close practical knowledge of financial markets and products.

His areas of expertise include foreign exchange, derivatives, economics and finance. He taught at the graduate level at Fordham University and in The University of Chicago’s Financial Mathematics Program. He received his PhD in Mathematical Economics from The University of Chicago.

Dr. Weithers has an affiliation with AACG and has often testified as an expert witness in Federal Court and Federal Tax Court.

Dr. Pavithra KumarPrincipal of Advanced Analytical Consulting Group, specializes in the application of economic and financial theory to questions arising in complex securities and finance litigation. She has expertise in securities class actions, structured finance disputes, damages quantification and valuation, and is proficient in the use of sophisticated statistical modeling and econometric techniques, including event studies and market efficiency analyses. She has been engaged as an expert in securities, damages and valuation-related matters. She is a PhD in Finance from the MIT Sloan School of Management.
